Critical Notice to Directors

FluxFrontier is a **System of Intelligence** designed to assist with NDIS compliance. It is **NOT** a substitute for professional legal advice or clinical judgment. The "Human-in-the-Loop" requirement is mandatory; all AI proposals must be reviewed and approved by a qualified human representative of your organization.

1. Agreement to Terms

By accessing the FluxFrontier platform, you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you (the "Provider") and Flux Frontier Pty Ltd, a registered Australian company.

These terms are structured to reflect the enhanced integrity requirements of the NDIS Amendment (Integrity and Safeguarding) Bill 2025.

2. Definition of Services

FluxFrontier provides a suite of Governance Orchestration "Shields" including but not limited to:

  • Incident 24 Shield: Automated triage and classification of reportable incidents.
  • PACE Integrity Shield: Pre-submission validation of NDIS claim data.
  • Restrictive Practice Shield: Clinical governance and unauthorized practice detection.
  • Utility Suite: Standalone audit tools for document and billing validation.

3. The Human-in-the-Loop Standard

FluxFrontier operates on a Deterministic Governance model. This means:

  • AI Recommendation: The AI engine will propose a classification (e.g., ISR1) based on the NDIS Rules.
  • Mandatory Review: A human Manager or Director must review every AI proposal.
  • Final Authority: The submission of any data to the NDIS Commission is the sole responsibility of the Provider. FluxFrontier does not submit reports autonomously without human approval.
  • Liability: The Provider remains legally liable for the accuracy and timeliness of all NDIS submissions. FluxFrontier is a decision support tool, not a legal representative.

4. Immutable Audit Trails

FluxFrontier utilizes Portkey to generate cryptographically-signed logs of every governance decision.

  • These logs serve as evidence that the Provider "took reasonable steps" to manage compliance—the legal standard under the new Integrity framework.
  • FluxFrontier guarantees the immutability of these logs. They cannot be edited or retroactively altered by either party once a decision is finalized.

Legislative Changes

The NDIS regulatory environment is volatile. While we strive for 100% accuracy, we do not warrant that the Service will reflect the most current legislative updates at every second. The Provider is responsible for staying informed of their obligations.

Limitation of Damages

To the maximum extent permitted by law, Flux Frontier Pty Ltd shall not be liable for any civil penalties, fines, or criminal liabilities incurred by the Provider, even if such penalties result from a delay or error within the Service.

6. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be handled within the jurisdiction of Victorian courts.
